Welcome — these Terms of Service ("Terms") govern your access to and use of discoverfunkyfox.com and any purchases you make from Funky Fox ("we", "us", or "our"). By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.

1. Scope & acceptance

These Terms apply to all visitors, users and others who access the Site ("you", "customer"). By accessing or using the Site and/or placing an order, you confirm that:

  • you are at least the legal age to form a binding contract in your jurisdiction; and

  • you accept and agree to these Terms.

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Site after changes are posted means you accept the new Terms.

2. Orders, confirmation & contract formation

  • All orders placed on discoverfunkyfox.com are subject to acceptance by Funky Fox and availability.

  • When you place an order you will receive an order confirmation e-mail. This confirmation does not mean your order has been accepted — it is an acknowledgement that we have received your order. We confirm acceptance of your order and form a contract when we send you a shipping confirmation or a separate acceptance message.

  • We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information, inability to obtain authorization for payment, or suspected fraudulent activity.

3. Pricing & payment

  • Prices shown on the Site are in Indian Rupees (INR) and are valid only where displayed. Prices may change from time to time.

  • We accept the payment methods displayed at checkout (credit/debit card, UPI, netbanking, popular wallets and Cash on Delivery where available). Payments are processed by third-party payment processors; Funky Fox does not store full card information on our servers.

  • If a payment is declined or delayed, we may cancel your order. You are responsible for any taxes, duties, or fees related to international orders.

4. Print-on-demand, customization & product variations

  • Many Funky Fox products are printed on demand and/or customized to your order. Because of this:

    • minor variations in color, placement, and sizing are normal and not defects;

    • exact color matches cannot be guaranteed due to screen-to-print differences;

    • small inconsistencies are part of the product’s handmade or print-on-demand nature.

  • If you require a strict color or fit requirement, contact us before ordering.

5. Cancellations, changes & production window

  • Because production typically begins quickly, cancellations are only possible if the order has not entered production. We recommend contacting us immediately (ideally within 2 hours of placing the order) to request cancellation. We will confirm whether cancellation is possible.

  • If production has started, we may not be able to cancel; in such cases, exchange/store credit options may apply (see our Return & Refund Policy).

6. Shipping & delivery

  • Estimated production and shipping times are provided on product pages and during checkout. These are estimates only and may vary due to demand, printing lead time, courier delays or customs for international shipments.

  • Risk of loss and title for items pass to you when the carrier picks up the shipment. If you never receive an order that tracking shows delivered, contact us and we will investigate with the courier.

7. Returns, refunds & exchanges

  • Our Return & Refund Policy explains returns, refunds, exchanges, and cancellations in detail and forms part of these Terms. Please read it carefully. (Link the Return & Refund Policy page on your store.)

8. Accounts & security

  • If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.

  • We may suspend or terminate accounts that violate these Terms, misuse the Site, or engage in fraudulent activity.

9. Intellectual property

  • All content on the Site (text, graphics, logos, images, product designs, page layouts, software) is owned or licensed by Funky Fox and protected by applicable intellectual property laws.

  • You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without our prior written permission.

  • If you submit user-generated content (reviews, photos, designs), you grant Funky Fox a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish and display that content on our Site, social channels, and marketing materials, unless you have specifically agreed otherwise. You represent that you have the right to grant this license and that the content does not violate any third-party rights.

10. User content & prohibited conduct

  • You agree not to upload or submit content that: infringes intellectual property rights; is unlawful, abusive, defamatory, obscene, or otherwise objectionable; or contains viruses or harmful code.

  • You may not use the Site for any illegal purpose or in a manner that interferes with other users’ access.

11. Third-party services & links

  • The Site may contain links to third-party sites, services, or partners (payment processors, shipping providers, social platforms). We are not responsible for their content, privacy practices, or terms. Your use of third-party services is at your own risk.

12. Disclaimers

  • THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. FUNKY FOX DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • We do not guarantee that product colors on your screen will exactly match the physical product, or that the Site will be error-free or uninterrupted.

13. Limitation of liability

  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FUNKY FOX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT(S).

14. Indemnification

You agree to indemnify, defend and hold Funky Fox and its affiliates harmless from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your user content.

15. Force majeure

We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, acts or omissions of third parties (couriers, suppliers), government actions, or network unavailability. In such cases, we will attempt to notify you of delays.

16. Governing law & disputes

  • These Terms are governed by the laws of India.

  • Any disputes arising from or related to these Terms, the Site, or your purchase will be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

  • Nothing in this clause prevents either party from seeking urgent injunctive relief in any competent court.

17. Termination

We may suspend or terminate your access to the Site at any time for violations of these Terms, fraudulent activity, or other conduct we reasonably deem harmful. Upon termination, all rights granted to you will immediately cease.

18. Severability & waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Failure to enforce any right does not constitute a waiver of that right.

20. Additional consumer rights
